YouTuber Ranveer Allahbadia, embroiled in a controversy over his remarks on the YouTube show India’s Got Latent, has received interim protection from arrest from the Supreme Court. The relief applies to FIRs lodged against him in Assam and Maharashtra, but comes with strict conditions.

Court’s Directives and Conditions

The Supreme Court, while granting temporary relief, imposed the following conditions on Allahbadia:

  • Passport Surrender: Allahbadia must deposit his passport with the Nodal Cyber Police, Thane.
  • Travel Restrictions: He cannot leave India or travel abroad without prior permission from the court while the investigation is ongoing.
  • Content Ban: The court prohibited Allahbadia and his associates from airing any show on YouTube or any other audio/video platforms until further orders.

Additionally, the court ruled that no further FIRs would be registered against him regarding the controversial remarks.

SC’s Strong Condemnation of Allahbadia’s Remarks

A bench of Justice Kant and N Kotiswar Singh criticized Allahbadia’s remarks, calling them “vulgar” and stating that they brought shame to society.
“The words you have chosen—parents, daughters, sisters, and younger brothers—will feel ashamed. The entire society will feel ashamed,” the bench stated. The court further questioned, “If this is not obscenity, then what is the standard of obscenity in this country?”

Allahbadia’s Lawyer Responds

Defending his client, senior advocate Abhinav Chandrachud acknowledged that he was personally disgusted by the statements made in the episode but questioned whether the remarks warranted criminal prosecution.
Chandrachud cited a previous Supreme Court ruling that stated “disgust or revulsion alone does not amount to obscenity.” He further argued that profane language is not the same as obscenity, and only content that provokes lustful or sexual thoughts in a reasonable person qualifies as obscene.

Allahbadia’s Next Steps

The Supreme Court has allowed Allahbadia to approach local police in Assam and Maharashtra for protection in case of threats. However, his legal battle is far from over, as the court’s observations suggest that his remarks could have serious consequences.
