A Vienna-based privacy campaign group, NOYB (“None of Your Business”), has announced its intention to file a complaint against OpenAI’s ChatGPT in Austria. The complaint alleges that ChatGPT, a flagship AI tool, produces inaccurate and “hallucinating” answers, raising concerns about data accuracy and privacy.

A Vienna-based privacy campaign group, NOYB (“None of Your Business”), has announced its intention to file a complaint against OpenAI’s ChatGPT in Austria. The complaint alleges that ChatGPT, a flagship AI tool, produces inaccurate and “hallucinating” answers, raising concerns about data accuracy and privacy.

NOYB’s statement on Monday highlighted the fundamental issue of ChatGPT’s inability to provide accurate information, with OpenAI openly acknowledging its inability to correct inaccuracies generated by the AI tool. This lack of transparency and accountability regarding data sources and storage practices is a significant concern for NOYB, especially in light of EU laws mandating the accuracy of personal data.

Maartje de Graaf, a data-protection lawyer at NOYB, emphasized the necessity for technology to adhere to legal requirements rather than the other way around. NOYB’s complaint specifically mentions instances where ChatGPT provided incorrect information about individuals, such as NOYB founder Max Schrems’ birth date, without clarifying the absence of necessary data.

Moreover, NOYB criticized OpenAI for its refusal to rectify or erase incorrect data despite requests from affected individuals, citing it as a violation of EU data protection laws. The group highlighted OpenAI’s inadequate response to data access requests and its apparent non-compliance with legal obligations.

This complaint marks another challenge for OpenAI’s ChatGPT, which gained attention for its impressive capabilities in generating content but has faced increasing scrutiny and legal actions in various countries. Italy previously blocked the program temporarily, and France initiated an investigation following complaints.

In response to such criticisms and legal actions, a European working group has been established to enhance coordination in regulating AI technologies. However, NOYB remains cautious about the effectiveness of regulatory efforts in addressing privacy concerns surrounding AI tools like ChatGPT. The complaint filed in Austria seeks to hold OpenAI accountable and ensure compliance with EU data protection laws through potential fines and regulatory measures.
