The Punjab and Haryana High Court has intervened to ensure the safety of a businessman and his family, directing Chandigarh Police to provide them with protection for a week. This action came after the businessman filed a petition citing alleged threats from Bharatiya Janata Party (BJP) Member of Parliament Kirron Kher and one of her associates.

The petitioner, represented by senior advocate Anmol Rattan Sidhu, expressed concerns over the safety of himself, his wife, and their two minor daughters, claiming to fear for their lives due to purported threats from the Chandigarh MP and her aide.

Allegedly, financial disagreements between the petitioner and the respondents, involving a substantial investment of ₹8 crore from Kirron Kher, prompted the apprehensions. It was disclosed that a portion of the investment, ₹2 crore, had already been repaid, with the remaining sum pending reimbursement due to market fluctuations affecting profits.

The petitioner asserted facing pressure to immediately return the remaining amount along with interest, citing alleged harassment from Kirron Kher and her associate. Notably, there has been no public response from Kirron Kher regarding these claims.

During the court proceedings, the public prosecutor highlighted the absence of any formal complaints lodged at police stations regarding the threats, challenging the petitioner’s assertions. It was further emphasized that neither the petitioner nor his family contacted the designated helpline number for such concerns.

In response, the petitioner’s counsel stressed the urgency of the situation, considering the profile of Kirron Kher, urging the court to prioritize the protection of life and liberty.

In its ruling on December 11, the High Court emphasized the necessity of constitutional jurisdiction in safeguarding the petitioner and ordered a week-long protection period. However, it outlined stringent conditions, limiting the movement of the petitioner and his wife outside their residence except for essential purposes, underlining penalties for violations.

The court clarified that any breach of these conditions would lead to an automatic recall of the protection order, highlighting its intention to ensure compliance and prevent misuse of the granted safeguard.

The case signifies the court’s proactive stance in addressing concerns of safety and the delicate balance between constitutional jurisdiction and individual rights.
