Court Criticizes Amazon’s Business Strategy
Justice Prathiba M. Singh, presiding over the case, criticized Amazon for its attempt to “obfuscate” responsibility by operating under different roles—as an intermediary, retailer, and brand owner—to avoid legal liability for trademark violations.
The court also noted that Amazon was already aware of BHPC’s exclusive rights over the mark, having been involved in similar legal disputes in multiple jurisdictions, including the United Kingdom. The court issued a permanent injunction against Amazon, prohibiting it from selling products that infringe on BHPC’s trademark.
Beverly Hills Polo Club’s Trademark and Legal Stand
Beverly Hills Polo Club’s trademark features a charging polo pony with a player holding a polo stick, symbolizing the sport of polo, luxury, and a premium lifestyle. The company argued that its logo and branding serve as a unique identifier and are registered in 91 countries, including India, the US, UK, UAE, Germany, Nepal, and Mexico. BHPC launched its products in India in 2002.
The lawsuit was originally filed in 2020 by Lifestyle Equities, the owner of the Beverly Hills Polo Club trademark.
Amazon’s History of Trademark Disputes
This is not the first time Amazon has faced trademark infringement allegations from BHPC. In 2019, Lifestyle Equities sued Amazon in London for similar violations. In 2023, Amazon lost an appeal against a UK court ruling that found it had infringed on BHPC’s trademarks by targeting British consumers on its US website.
